Collective review of bylaws and policies

Porirua City Council is reviewing four bylaws and two policies. They are the Transport Bylaw, Alcohol Control Bylaw 2018, Water Supply Bylaw 2019 and General Bylaw 1991 (Part 9 Reserves Bylaw). The policies are the Litter Infringement Policy 2019 and the Dangerous, Affected and Insanitary Buildings Policy 2020.

As part of this process, the Psychoactive Substances Policy (Local Approved Products Policy 2015) will be revoked as no retailers in New Zealand are currently allowed to sell psychoactive substances, and there are no psychoactive substances approved for sale in New Zealand.

Here's what we are asking:

Alcohol Control Bylaw 2018

Review bylaw and make the necessary amendments

Council will maintain the current Alcohol Control Bylaw with very minor changes to alcohol ban zones and times.

Do not review bylaw at present time

This would mean that Council would have to review the bylaw at a later date, but before December 2025 when the bylaw becomes outdated.

Water Supply Bylaw 2019

Review bylaw and make the necessary amendments

Council will maintain the current Water Supply Bylaw with very minor changes.

Do not review bylaw at present time

This would mean that Council would have to review the bylaw at a later date, but before June 2026 when the bylaw becomes outdated.

General Bylaw 1991 Part 9 Reserves

Review bylaw and make the necessary amendments

We consider re-enacting the bylaw in its current form, the most efficient course of action.

This would mean that Council would have to review the bylaw at a later date, but before September 2025 when the bylaw becomes outdated.

Transport Bylaw 2021

Review bylaw and make minor change to the consultation process

This option seeks to alter the Bylaw to streamline decision-making processes. The remainder of the bylaw will remain unchanged.

Do not review bylaw and changes to the consultation process will not be made

Council will maintain the current Transport Bylaw’s consultation process. This option is not recommended as the current notification process causes delays in making decisions.

Litter Infringement Policy 2019

Review policy and make minor changes to infringement fees

Council will make a minor change to the fees for littering offences requiring infringement fees.

Do not review policy

This would mean that the self-imposed requirement to renew the policy has not been met, resulting in the policy remaining overdue for review.

Dangerous, Affected and Insanitary Buildings Policy 2020

Review policy and make the necessary changes

Council will maintain the current Dangerous, Affected and Insanitary Buildings Policy with very minor changes.

Do not review policy

This would mean that the requirements to renew the policy under the Building Act 2004 would not be met and the policy will be overdue for review.

On 15 May 2025, the Social Impact Assessment used to inform the recent review of the Local Alcohol Policy was attached to this consultation. This can be found in the 'Consultations Documents' tab. This document outlines the evidence base used by officers to conclude that the level of crime and disorder experienced before the Alcohol Control Bylaw 2018, is likely to return if the bylaw is not re-enacted. Apologies for not including this document when consultation on the Collective Review of bylaws and policies opened on 6 May 2025.
